They responded hours later by having the CEO, Bob Iger resign from his position (Click Here), but they did not give an official statement concerning the criminal evidence.

Legal Opinion

RE: OPINION ON EXPRESSIVE CONDUCT FROM JACK KIRBY AS CONFESSIONS OF GUILT TO FEDERAL CRIMES 

PURPOSE

The purpose of this letter is to provide legal analytical data concerning Jack Kirby’s & The Walt Disney Company expressive conduct in 1978 Black Panther Issue #7 to suppose if its admissible as a statement against interest, confession of guilt in US Federal Courts. 

CONCLUSION 

The expressive conduct in 1978 Black Panther Issue #7 is admissible under federal rule of evidence #401 & #402 as confessions of guilt because simple logic suffices to conclusively interpret the expressive conduct as statements against the interest of the deceased declarant with extreme probative value and unignorable relevance as material evidence. That material evidence is fundamentally central to the federal complaint, lacking reasonable grounds for the defense to argue prejudice or confusion under F.R.E. #403. The blatant expressive conduct establishes motive and intent to confess to the federal crimes of perjury, misappropriation, fraud, counterfeiting, money laundering, unjust enrichment and Alien Exploitation in violation of international laws such as Article 1 of UN Resolution 1514, corroborated by thousands of federal copyright certificates including, but not limited to; #PA0002205157 registered as “Anjiru Clan Secrets: Original Source Material Adapted to Vibranium, Wakanda & Black Panther in Marvel Comics & Motion Pictures”. 

ALLEGED GRIEVANCES 

  1. Jack Kirby obtained and used tribal secrets from the Anjiru Clan of the Gikuyu Tribe to create the Black Panther Brand and Vibranium found within the Marvel Comic Universe without permission from the custodians of said tribal secrets.
  1. The Walt Disney Company and its subsidiaries copyrighted, assigned, licensed, produced and globally distributed the unauthorized derivative works under the guise of owning the IP rights to said tribal secrets.

FEDERAL RULE OF EVIDENCE 401 

The material fact about issue #7, is that its most relevant purpose was to introduce the official history and origin of the most fundamental details in the Black Panther story, which is the entire basis for the federal action against the defendants, since the victim’s complaint is that the history originates with them. 

The history of Black Panther’s fundamental details indicated by Jack Kirby’s expressive conduct in Issue #7 include (1) The origin of the country Wakanda (2) The origin of the King of the Country, (3) The origin of the Vibranium Metal that sustains the country (4) The origin of the Sacred Herb used to bestow the strength of the Black Panther (5) The origin of the name “Wakanda” (6) The name of the real african bloodline who’s sacred traditions he borrowed from to provide the fundamental details for the story (7) The distinct orange traditional attire featured several times on the cover of Issue #7 from the real african bloodline who’s sacred traditions he borrowed from to provide the fundamental details for the story 

If the details expressed in this issue were removed from the Marvel Comic Universe entirely, Black Panther simply could not exist whatsoever. Furthermore, all other Marvel storylines that include Vibranium would be affected as well, some more than others. Therefore the expressive conduct of Issue #7 has extreme probative value relevant to the consequence of the federal action. 

FEDERAL RULE OF EVIDENCE 402 

The expressive conduct found in Black Panther Issue #7 has extreme relevance according to F.R.E. 401, but according to F.R.E. 402 could be challenged by the hearsay rule because Jack Kirby has been deceased since 1994 and will not be able to testify or be cross examined. 

His expressive conduct discovered in issue #7 is the only available statement regarding the material fact of consequence to determine the federal action. 

By law, his expressive conduct is considered an unsworn, non-judicial statement made outside of the court, to confirm the applicability of the hearsay objection. 

However, the hearsay rule has little to no chance of dismissing the expressive conduct as a confession of guilt because the highly straight forward nature of the practical / logical interpretation of the expressive conduct is corroborated by too many identical fundamental qualities found in the source material registered under federal copyright certificate #PA0002205157. 

The corroborating evidence will certainly qualify the expressive conduct as statements against the interest of the declarant. This legally makes the expressive conduct exempt from the hearsay rule and will assure the 1978 Black Panther Issue #7 is admissible in Federal Court to establish motive and intent of Jack Kirby to give artistic comic book styled credit to the Jiru people for inspiring his adaption of their tribal secrets which is legally a confession of guilt to all charges filed.

There will be little to no room to argue confusion or prejudice under F.R.E. #403 because the similarities are identical in several critical instances. Especially by Jack Kirby honoring the Jiru People in B.P. Issue #7 by introducing an entire new character in the issue and naming the character ‘Jiru’ after their clan name. That is arguably the highest honor a comic book artist can give somebody in a comic book they both illustrated and scripted, which the Marvel Database credits Jack Kirby for both jobs in Issue #7. 

If the 1978 Black Panther Issue #7 is admitted as a confession of guilt in Federal Court it will cause all the other evidence to cascade onto the defendants which include more expressive conduct from both Jack Kirby in other issues and the current Black Panther comic book writer Ta Nehisi Coates. 

Ta Nehisi Coates made another critical reference to a real african tribe in reference to the Fictional Nation of Wakanda. Once again that reference was made to the Kikuyu Nation of the Jiru People (Ajiru) by naming the sacred mountain of Wakanda “Mena Ngai” 

Ngai is the name of the God for the Ajiru Clan and Kikuyu Nation. 

“Mena Ngai” in their language means “With God”, which is another identical similarity to the sacred mountain, Mt. Kenya. The Ajiru Clan have lived on the slopes of Mt. Kenya for almost a millennium. It’s public knowledge that the Kikuyu Nation say their God, Ngai lives on Mt. Kenya. 

This is the same mountain that was formed by a meteorite millions of years ago, according to their tribal secrets copyrighted under certificate #PA0002205157 

 

PERJURY ON FEDERAL COPYRIGHTS 

Copyright forms are submitted under penalty of perjury. None of Marvel’s copyrights have the Anjiru clan listed under section 6A. This is a federal declaration that Disney is the owner of the Anjiru clan secrets. The existence of copyright certificate #PA0002205157 is federal evidence proving that assertion as a falsehood, which is perjury. 

If the defendants have committed perjury for not citing the Ajiru clan in section 6A of the copyright forms associated with the Black Panther franchise or any work that incorporates “Vibranium”, then the said copyrights are invalid in the eyes of the law Federal Court due to falsifying information on a federal documents. 

The Ajiru clan will likely be awarded the copyrights to all works owned by The Walt Disney Company in violation of their source material dating back to 1966. 

UNJUST ENRICHMENT 

Aside from losing valuable intellectual properties, the charge of unjust enrichment carries a mandatory restitution penalty and can potentially bankrupt the Marvel Studio’s division because every dollar generated in violation of the Anjiru Clans secrets constitute unjust enrichment unless a contract can be produced as evidence proving the Walt Disney Company, Subsidiaries & Assignees had permission to use the source material for adaptation.

The criminal activities in question make this case a RICO and can require restitution several times the amount of the monies generated by the criminal activity
